On Friday January 10, 2025 I Officer Grier was dispatched to the area of the 1400 block of Parkway in Crossett due to a caller advising there had been some type of distrubance resulting in destruction of property at the Cosby Greenhouse. Once arriving in the area, I was alerted by Kevin Cosby that the driver of the white GMC Yukon leaving the area was the supsect, at which time I made an effort to catch up to the vehicle and ultimately stopped the vehicle for driving without their headlights on as well as in order to detain them pending further investigation in regards to the disturbance.
The driver was identified shortly after as Joshua Robinson (AR/Number Redacted). I introduced myself to Joshua as Officer Grier with the Crossett Police Department and explained that the reason I stopped him.
In speaking with Joshua, I was able to detect an ordor of intoxicants as well as the immediate odor of marijuana from his person and in gauging his physical state in which he exited the vehicle coupled with his bloodshot watery eyes, he was then placed under arrest for Driving While Intoxicated. Joshua stated that he had in fact consumed approximately 1/3 of a bottle of whiskey and stated he had previously smoked marijuanan earlier in the day. I then moved Joshua to a location facing away from the road in order to then conduct a series of field sobriety tests.
I began the series of tests with asking Joshua if he wears eyeglasses to which he stated he did not. I explained to Joshua that he should stand with his arms at his sides and his feet together while following the tip of my stimulus with his eyes and his eyes only and not moving his head. Joshua stated he understood my instructions. I then began attempting to see if there was a presence of equal pupil size and resting nystagmus then began checking for equal tracking in both eyes which was successful with no resting nystagmus.
I then began to check for lack of smooth pursuit which was distinct as Joshua’s eyes began to “skip” as they were moving from right to left and back again and Joshua continued to slightly move his head left and right following with his eyes. I then instructed Joshua again to look with his eyes and his eyes only and not to move his head, asked for his understanding to which he replied he understood as well.
I then began to observe for distinct and sustained nystagmus at maximum deviation to which again I observed Joshua’s eyes to be “skipping” while following along and him to be continually following with moving his head in the direction of my stimulus moving. I then continued on to the next test being the walk and turn, and gave the instructions beforehand while presenting a demonstration of the test. I then instructed Joshua to look at his feet, to count his steps out loud, keep his arms at his sides, and ensure his steps are heel to toe while taking 9 heel to toe steps along a straight and invisible line out in front of him. Joshua stated he understood my instructions and began to demonstrate the walk and turn and I observed his performance.
I then proceed onto the next test beign the one leg stand. I explained that Joshua would to keep his arms at his sides and feet together during my instructions to which he had to be reminded to keep his arms at his sides. I explained he would raise a leg of his choosing approximately 6 inches off the ground and parallel to the ground and count out loud “one thousand one, one thousand two..” and onwards until told to stop then observed his performance. I then concluded my field sobriety test and Joshua was arrested for Driving While Intoxicated and secured in the patrol vehicle of Officer Terrell.
Joshua was also found to have a suspended driver’s license at the time of operating the white GMC Yukon so his vehicle was subsequently towed. While performing a vehicle inventory in accordance with the Crossett Police Department policy, one container of Mad Dog Whine (approximatley 2/3 full) and one unopened can of Michelob Ultra was found in the console as well as a cigarette packet containing several smoked marijuana cigarettes remnants which emanated the odor of marijuana.
Joshua Robinson was then transported to the Crossett Police Department by Officer Terrell. I read Joshua his DWI Arkansas Statement of Rights and he signed them before he was able to successfully provide a breath sample on the BAC machine. The final result of Joshua breath sample was a .069 and he was released into the custody of a sober and responsible adult with one citation for Driving while suspended, revoked, or Cancelled.
