
At approximately 11:03 pm, dispatch received a call about a black Ram truck that had driven into the ditch near the Wildlife Bar on E Superior, and then drove away after getting the truck out of the ditch.
As Officers were out looking for the vehicle, another call came into dispatch stating that the truck had been left abandoned around N Porter St and W Superior St wrecked.
Officer Jackson and Sgt. Stewart arrived at the location of the truck and were advised that the
driver had walked away. A witness gave a description of the driver and I, Det. Foster, began looking for the driver.
At approximately 11:20 pm, I located the driver around W Huron and N Lowe. The driver was identified as Bo Mitcham. At approximately 11:21 pm, Mitcham was placed under arrest for the suspicion of DWI due to the way he was walking, talking, and standing. He was swaying and wobbling while he was walking and standing, and his speech was very slurred.
Mitcham had a strong odor of intoxicants coming off his person and breath.
Sgt Stewart and Officer Jackson advised that there was also a strong odor of intoxicants coming from the vehicle.
Mitcham was asked if he needed medical attention due to the vehicle accident and he refused.
Mitcham was then transported to the Stuttgart Police Department where breath test could be administered.
After Mitcham was advised of his rights by Det. Foster, he refused the breath test and was charged with refusal to submit to a chemical test. Mitcham was then transported to the Arkansas County Detention Center.
