Desha AR Sheriff Dept Deputy Womack BWC 03/21/25 Investigating DUI Moped Crash On HWY 1 Near State HWY 4

On March 21st 2025 at approximately 6:45 p.m., I, Deputy K. Womack, received a call in regards to a male party who crashed his moped and was laying in the road on State Highway 1 near the intersection of State Highway 4.

Upon my arrival, I noticed Willie Charleston (DOB 1-14-1949) sitting on an inoperable, crashed moped. Willie was disoriented, and trying to put the pieces back together on the moped.

He stated he did not crash but stopped on his own. I asked him if he had been drinking and he stated he was not drinking.

His eyes were watery and bloodshot and his speech was incoherent. He stated he did not know why people stopped him and I said he didn’t get stopped but he had crashed.

Willie said he did not crash again, but he stopped on his own. I noted his hands cut deep and bleeding as well as debris from his moped scattered over the side of the highway.

Two witnesses, Christopher Oswell (DOB 06-27-1990) and Randy Dickson (DOB 08-06-1985) said they saw Willie crash, and laying in the middle of the road.

He laid unconscious for about ten minutes according to Oswell, and right before we arrived, Willie had got up and got on his moped.Willie refused medical help.

I then administered Willie a Preliminary Breath Test which showed a result of 0.006. Willie continued to be incoherent and stating he did not crash. I believed Willie to be under the influence of illegal narcotics at this point due to his demeanor and low Blood Alcohol Content level. Willie has a history of illegal drug use, so I proceeded to try to administer Three Standardize Field Sobriety Test. When I asked him his birthday, he stated November 14th, 1959, but then stated January 14th, 1959.

He then asked me if he had an accident and I told him yes. Then he stated yet again that he didn’t have an accident. I also had to ask him several more times if he would do the test to which he finally agreed. Willie showed all six clues on the Horizontal Gaze Nystagmus Test. He showed Vertical Gaze Nystagmus. He showed all eight clues on the Walk and Turn Test. He showed all four clues on the One-leg Stand Test.

Willie was then placed under arrest. He continually stated he didn’t crash. He also was still very incoherent when he spoke. He was asked if he had any drugs or anything illegal on him before we took him to jail and he stated he did not have anything. I asked Willie if he would consent to a blood test at the hospital numerous times and he wouldn’t answer. Finally Willie said he would be honest with me.

He stated he had smoked methamphetamine. When I asked him to repeat himself he stated he smoked drugs, and whatever they had in a pipe. Willie was then marandarized for further questions. He kept repeating he had smoked whatever they put in the pipe, but did utter “methamphetamine” prior.

He stated he had some marijuana as well. When we asked him again about taking a blood test he stated he had already told us he was “drinking”. Willie asked me while en route to the hospital why I had him in the back of my patrol unit and why he was stopped.

I repeated the whole story to him again. He asked me again why I stopped him, and I told him numerous times that I did not stop him, but got a call because he crashed. Willie asked me where we were going and I told him to the hospital for a blood draw that he had consented to and explained to him again why. This continued the whole ride to the Mcgehee Hospital.

Upon my arrival to the hospital, we prepared to work with staff for a blood draw and after several minutes of the same behavior from Willie, he refused.

He was then taken to Mcgehee City Jail for booking. We asked Willie at the door of the jail if he had anything illegal on him and he stated he did not.

Willie had what appeared to be a crystal like shard of methamphetamine in the pocket of his coat, and a glass pipe with a burned end and crystal like substance inside it as well. The pipe was located in the front chest inside pocket.

Willie proceeded to get aggressive with me at the jail upon hearing his charges, and had to be placed back into cuffs. He then stared at me and went blank for a moment and stated that I was pretty and he wouldn’t hit a woman.

I read Willie his Arkansas Implied Consent Statement of Rights and went over his Notice of Suspension/Revocation.

He was charged with Careless and Prohibited Driving, Driving on a Suspended License, Refusal to Submit to a Chemical Test, D.W.I. Drugs, Possession of Methamphetimine, Possession of Drug Paraphernalia, and Furnishing Prohibited Articles.
